Welcome to Quest for Exams. These Terms and Conditions (the "Terms") govern your use of our website and services, accessible at questforexams.co.uk (the "Website"). By accessing or using our Website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Website.

1. User Registration and Profiles

1.1 Registration: To access certain features of the Website, parents or guardians must register and create an account. Registration requires the provision of accurate information including your name and email address.

1.2 Child Profile: After completing the initial registration, parents or guardians may add a profile for their child. This profile requires the child’s name (or a nickname, if preferred) and grade level. The option to use a nickname is provided to enhance privacy and create a secure and personalised learning environment.

In addition, parents are required to create a unique user ID for the child, which will enable the child to access their own portal. The parent is responsible for maintaining the confidentiality and security of the user ID and ensuring that it is used in accordance with these Terms.

1.3 Privacy and Security: All personal information collected is used in accordance with our Privacy Policy and applicable data protection laws. We are committed to ensuring the privacy and security of your information.

2. International Data Management

2.1 Data Management: Our data management facilities are located outside the UK. However, we ensure compliance with local and international data protection regulations, including the laws applicable in your country of residence.

2.2 Data Protection: We implement robust security measures to protect personal data from unauthorised access and processing. This includes encryption, secure storage, and access controls.

5.1 Practice Material: Our mock exams and practice papers are designed to closely simulate real exam conditions and are based on familiarisation papers that help students prepare effectively. They further include original content as well as proxies of GL, CSSE, SET board exams, and independent school admission papers. While we aim to structure these practice papers and mock exams to reflect actual exam formats and difficulty levels, it is important to note the specific format of a practice paper or exam can differ depending on the requirements of each school or institution. Our material may not always replicate these exact formats, and some variations may exist as they are created independently. 

5.2 Past Papers: We provide solved past papers to assist with your exam preparation. These include original answers and detailed explanations to help students understand the material and develop exam techniques. Charges apply only to our original solutions and explanations, not the publicly available question papers. Users must respect copyright and intellectual property terms associated with the original question papers and use our materials as part of broader study efforts.

6. Comprehension Content Sourcing

6.1 Passages: We use public domain passages for comprehension exercises. Original questions and answers are created by our team based on these passages.

6.2 Content Ownership: We do not claim rights to the original passages but retain rights to our proprietary educational content.

7. School Information Disclaimer

7.1 Information: We provide descriptive overviews of schools, including details on admission criteria, catchment areas, exam formats, and deadlines, based on publicly available information. While we strive to ensure the accuracy of this information, users are advised to verify details directly with the schools. Due to the fact that dates can vary each year and schools may not always update the information on their websites, there is a possibility of human error. Therefore, Quest for Exams does not guarantee the completeness or current accuracy of all school-related information.

8. Educational Use Agreement

8.1 Purpose: The Website is for educational purposes only. Misuse, including sharing account details or using the platform for commercial purposes, may result in account suspension.

8.2 Account Security: Users must maintain the confidentiality of their account details and use their accounts solely for personal educational purposes.

8.3 Integrity: Users must respect copyright laws, avoid plagiarism, and engage in honest conduct during assessments.

8.4 Reporting: Users are encouraged to report any misuse or issues to us. Violations may lead to account suspension or termination.

9. Product Expiry and Family Accounts

9.1 Validity: All educational products purchased on the Quest for Exams platform, including study materials, practice papers, and mock exams, are valid for one year from the date of purchase. After this period, access to the purchased products will expire, and all progress data associated with that specific bundle will be removed. Users are advised to review and save any important progress data before the expiry date, as this information cannot be retrieved once the product has expired.

9.2 Family Accounts: Each parent account can create and manage up to two child profiles. Parents can assign purchased educational products to any of their child profiles. To create additional profiles beyond the limit of two, an additional fee will apply based on the number of extra profiles and the extent of access required for each.

10. Analytical Reliability Clause

10.1 Analytics: Performance analytics are based on user engagement and are intended as a guide. The reliability of these analytics depends on accurate usage of the platform.

10.2 Data Retention: Upon expiry of educational products, related analytics and progress data will be removed.

11. Tutor Profile, Verification, and Masterial Use

11.1 Tutor Portal: Private tutors can sign up and use the Quest For Exams Tutor Portal to access and assign our materials to their students. Tutors can only use the materials provided by us on the website. 

11.2 Subscription Model: Tutors are required to pay for and maintain an active monthly subscription in order to access and use the Tutor Portal. This subscription grants access to our materials and platform features as per the selected plan. 

Important Clauses for Subscription Payment:

• Non-Refundable Subscription Fees: All subscription fees are non-refundable, regardless of usage or participation levels by the tutor or their students. 

• Automatic Renewal: Automatic renewals apply unless cancelled by the tutor before the renewal date.

• Package Selection and Changes: Tutors should carefully choose their package based on their expected usage. Once a package has been selected, changes can only be made by manually canceling the current plan. Upgrades or downgrades can then be purchased and will take effect at the start of the next billing cycle.

• Fee Liability: Tutors are fully responsible for ensuring timely payments of their subscription fees. Failure to maintain an active subscription will result in restricted access to the Tutor Portal.

11.2 Registration and Verification: Tutors must undergo a verification process to ensure safety and credibility. This process requires the submission of the following documents:

• Proof of Employment: Documentation verifying the tutor's current employment status.

• DBS Check: A Disclosure and Barring Service (DBS) certificate or equivalent to confirm the tutor’s suitability to work with students and to ensure no misuse occurs on the platform.

• Educational Qualifications: Certificates or transcripts demonstrating the tutor’s academic background and subject expertise.

By submitting these documents, you give us your consent to collect, process, and securely store your personal data as part of the verification process. Your information will be handled in compliance with applicable data protection laws, and we will only use it for purposes related to your use of the platform. Submission of these documents does not guarantee approval. Quest for Exams reserves the right to approve or decline any tutor account at its sole discretion, including but not limited to reasons related to the alignment with our platform standards. We are not obligated to provide justification for a declined application.

11.3 Parental Consent and Student Safeguarding: Before inviting any student under 18 years of age to the platform, tutors are required to obtain and document explicit consent from a parent or legal guardian. Students and their guardians must also accept the Student Terms and Conditions before access is granted. Tutors are expected to maintain a secure, respectful, and privacy-conscious learning environment.

11.4 Limitations of Liability: Tutors using the platform operate independently and are not employees, agents, or representatives of Quest For Exams. Quest For Exams does not supervise, monitor, or guarantee the quality, conduct, or instructional content delivered by tutors. Tutors are fully responsible for their own teaching practices and communication with students and parents. Quest For Exams does not assume responsibility for tutoring outcomes, the accuracy of tutor-provided content, or any communication or activity that occurs outside of the platform. 

11.5 Ownership and Use of Materials: All materials provided through our platform are proprietary and must not be copied, shared, or used for purposes other than those explicitly permitted by us. Any misuse, duplication, or unauthorised distribution of our materials is strictly prohibited. 

11.6 Material Accuracy: While we strive to ensure that all our materials are prepared to the highest standards, we do not guarantee error-free content. Tutors are welcome to report any errors they identify, but we assume no liability for such discrepancies.

12. GDPR Compliance

12.1 Data Rights: Users in the EU/UK have rights under GDPR to access, correct, or delete their data. Contact us to exercise these rights.

12.2 Processing: We ensure lawful and fair processing of personal data. Data security measures are in place to protect user information.

12.3 Transfers: Data may be transferred outside the EU/UK under conditions ensuring compliance with data protection laws.

15. Delivery of Digital Resources

15.1 Digital Access: All resources are delivered digitally. We do not provide physical shipments.

16. Indemnity

16.1 User Liability: Users agree to indemnify Quest for Exams against claims arising from breaches of these Terms or violations of law.

16.2 Assistance: We may assist in defending claims but retain the right to control defence and settlement.

17. Modifications to Service and Termination

17.1 Modifications: We may modify, suspend, or discontinue any part of the service without notice.

17.2 Termination: We may terminate user access for breaches of these Terms.

18. Payment and Subscription

18.1 Payments: Payments for products and subscriptions are processed securely through Stripe. We do not handle or store any credit card information. All payment details provided during checkout are managed by Stripe, our payment processing partner. We do not retain any of this data ourselves.

18.2 Subscriptions: Currently, we only offer the purchase of products, with no subscriptions available except for on the tutor portal, which is still under discussion. If a subscription service is offered in the future, it will be set up to renew automatically. Users will be able to cancel any subscriptions through their account settings. Please note that no refunds will be provided for unused periods.
